Phoenix Security Academy reserves the right to change its policies at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately. 1. Website Operation
Phoenix Security Academy may change, add, suspend, cancel, remove or otherwise modify the services offered on this website at any time without prior notice.
2. Prohibited Actions
Users of this website are prohibited from engaging in the following actions, including those prohibited by other provisions of these terms and conditions:
- Actions that will or may infringe on the copyrights, privacy, property and other rights or interests of other users of this website, third parties or Phoenix Security Academy.
- Actions that will or may cause disadvantage, financial loss or other damages to other users of this website, third parties, or Phoenix Security Academy.
- Actions that will or may be offensive to public order and morals, or violate laws, regulations, and ordinances.
- False declarations when using this website for membership registration or other purposes.
- Illegitimate use of email addresses, passwords, or other personal information.
- Using this website to solicit business or achieve other commercial ends for profit, or for preparations thereto.
- Other actions that may interrupt the operation of this website or interfere with the provision of services.
3. Personal Information
Phoenix Security Academy will properly handle personal information of users in accordance with the Privacy Policy posted separately on this website.
4. Copyrights and Other Rights
- Copyrights, trademarks, portrait rights and all other rights relating to this website belong to Phoenix Security Academy and The State of Texas unless specified otherwise. Users are asked to respect the protection afforded to holders of copyrights, trademarks, portrait rights and other rights.
- Users are prohibited from using, transposing, copying, distributing or modifying all or part of the data, images and any other form of content obtained from this website for any purpose other than personal use, as specified in copyright laws, or that which is explicitly permitted by other laws, without the consent of Phoenix Security Academy.
- If it is revealed that a student has copied the information contained in this course, either manually or electronically, the student will be subject to dismissal from the class without a refund. Additionally, the student may be subject to civil litigation.
- Taking notes is acceptable, but copying, plagiarism and redistributing the information herein is strictly prohibited. Legal action will be taken against all violators.
5. Student/Member/User
- Phoenix Security Academy reserves the right to immediately cancel a student membership, at any time without prior notice, if any of the following conditions apply to a student:
- The student intentionally gave false or inaccurate information to Phoenix Security Academy when registering for a course.
- The student intentionally enrolls in a course knowing he/she is disqualified from receiving a license due to his/her criminal record.
- It becomes clear that the student has had his/her membership revoked or received some other form of censure for violating these terms and conditions of use or other regulations in the past.
- The student engages in activities prohibited by the terms and conditions of use, or other Phoenix Security Academy policies.
- The student cannot be contacted via email, telephone or other means.
- Phoenix Security Academy deems any other act of a student as inappropriate.
- The student shall notify Phoenix Security Academy of any changes in his or her registered name, address, phone number or other personal information using means specified by Phoenix Security Academy.
- The student shall use his or her account information and password only for personal use, and must not transfer, loan, or otherwise provide them to third parties for the use of such third parties. ONLY the student who signed up for the class is permitted to complete the class.
- If it is discovered that a student did not complete the course on their own he/she will not receive a certificate of Completion or a refund and the State of Texas Regulatory Services will be informed so they may take action regarding the fraud committed.
- Students with a Criminal Record must inform our staff so that we can confirm they meet the State’s requirements to obtain a security license in Texas. If he/she is disqualified due to their criminal background and they choose to continue with the class without informing our staff then he/she will NOT receive a refund for the class. (See section regarding Disqualifying Offenses for more information).
6. Class Policies/Expectations:
- ONLY the student who signed up for the class is permitted to take the class, and complete the lessons, quizzes and Final Test therein.
- If it is proven that a third party completed the class in place of a student then the student will not receive a certificate of Completion nor will he/she receive a refund. Additionally, Phoenix Security Academy will inform the Texas Regulatory Services so they may take action regarding the fraud committed. If action is taken the student licenses are subject to revocation.
- Students will be given a reasonable time frame to complete each course. The designated time frame may differ from course to course. Refunds will not be given to those who fail to complete the course within the allotted time.
- If additional time is needed due to extenuating circumstances, the student MUST contact Phoenix Security Academy 24 hours before the date the student’s course is due to expire. At the discretion of Phoenix Security Academy, we may offer a course extension, on a case by case basis.
- The student should carefully read all information in each Lesson and pay attention to videos (if applicable). Once the student has successfully completed a course and has passed the Final Test, he/she will be able to download their Certificate from their “My Account” profile.
- Upon completion of a course, Basic Instructions for completing the State Requirements for Licensure or Renewal will be e-mailed to the student.
- Only one Certificate of Completion will be issued per Course. It is the student’s responsibility to print/save a copy for his/her records.
- Please Note: a $10.00 records fee will be charged for the request a copy to replace a lost or stolen certificate.
7. Laws/ Rules Regarding Armed Licensure:
- Regardless of whether a student holds a License To Carry (LTC) or he/she exercises their Constitutional Right to carry a firearm, he/she may NOT carry a firearm while engaging in the duties of a paid/contracted security officer. In order to carry a firearm while on duty, he/she MUST be a licensed (Level 3) Commissioned Security Officer. Failure to comply, may result in criminal charges being filed by the State or District Attorneys Office(s).
- The completion of a course does not constitute licensure. Completing the course and obtaining the certificate is a required step in the process of procuring a security license. The license itself is approved and issued by the Texas Department of Public Safety/ Regulatory Services Division.
Non commissioned (unarmed) officers can only begin working for a licensed company if:
- they have completed the course,
- submitted their application and
- submitted fingerprints (Must wait 48 hours after submission of prints).
- Once the non-commission card has beed received it must be carried while on duty.
Commissioned (armed) officers must wait until they have received their commission card and must carry it on their person while on duty.
